Supreme Court Rules in Favour of Tinubu’s Eligibility

The Supreme Court of Nigeria has affirmed the eligibility of Asiwaju Bola Tinubu, the President-elect, to contest the presidential election that held on February 25. In a unanimous decision by a five-member panel, the apex court held that an appeal filed by the opposition Peoples Democratic Party (PDP) lacked merit. PDP had sought Tinubu’s disqualification on the premise that the Vice President-elect, Senator Kashim Shettima, allowed himself to be nominated for more than one constituency ahead of the 2023 general elections. The party argued that Shettima’s dual nomination was in gross breach of the provisions of Sections 29(1), 33, 35, and 84(1) and (2) of the Electoral Act, 2022, as amended. Justice Tanko Muhammad Steps Aside as CJN

Justice Tanko Muhammad, the current Chief Justice of Nigeria has stepped aside from that office. This confirmation came a few hours after rumours of his resignation hit the airwaves. According to Punch Newspapers, confirmation of this news was given by his Special Assistant on Media and Communication, Ahuraka Yusu Isah. He's reported to have said "the latest information is that the CJN has resigned; I spoke with somebody very close to him and he said he has resigned." Supreme Court Declares Executive Order 10 Unconstitutional

The Supreme Court has declared as unlawful and unconstitutional the Executive Order 10 (EO10) issued by President Muhammadu Buhari on the funding of State Judiciary and Legislature. In a split decision on Friday, majority of the court’s seven-member panel agreed that the President exceeded his constitutional powers in issuing the EO10. Six out of the seven members of the panel proceeded to void and set aside the EO10. The majority decision also held that it was not the responsibility of the Federal Government to fund the capital and recurrent expenditures of the superior courts created for States under Section six of the Constitution. Supreme Court upholds INEC’s de-registration of Political Parties

The Supreme Court has upheld the 2020 decision by the Independent National Electoral Commission (INEC) to de-register some political parties for failing to win any election during the 2019 general elections. In a judgment on Friday, the Supreme Court held among others, that INEC acted in accordance with relevant provisions of the Constitution and the Electoral Act. The Supreme Court upheld an earlier judgment of the Court of Appeal, Abuja, which affirmed the earlier decision of a Federal High Court in Abuja on the issue.
